The Supreme Court of Russia has prohibited amendments to a charter preventing a spouse from becoming a member of a company during the period of dividing common property
When dividing a share in a company which is part of the common property of spouses, a spouse has the right to claim a part of the share or compensation for its value if the charter prohibits the entry of third parties into the company.
The Supreme Court of Russia considered a case when, during the process of dividing property, the company’s charter was amended to block the entry of new participants. The court stated that such changes were inadmissible if the division of property had already begun.
