The State Duma has approved in the first reading a draft law proposed by Rosreestr that introduces proportionality criteria between the size of a land plot and the real estate located on it when purchasing land without a public auction
The bill, developed as part of the roadmap to improve land use efficiency, amends the Land Code of the Russian Federation.
The aim of the proposal is to prevent situations where, under the pretext of a small structure, a buyer acquires a plot of land that far exceeds actual needs. The draft law proposes setting minimum development thresholds: at least 5% for plots intended for individual housing construction, personal subsidiary farming, or gardening, and 10% for all other types of land use. The structure must be a primary building, not a temporary structure.
The bill also allows for the denial of land purchase if the existing structure does not meet these criteria or is absent altogether.
