Sometimes parents may challenge their children’s marriage
The RF Supreme Court examined the parents’ claim to invalidate their deceased son’s marriage (No. 58-KG26-1-K9). Three instances terminated the case: parents may not challenge such a marriage.
The Supreme Court disagreed: the trial court failed to determine the parties and to consider involving the prosecutor as procedural claimant; ignored the parents’ prior complaint over the sham marriage, when the son’s illness barred his questioning; and disregarded the prosecutor’s objection to termination and support for a posthumous psychiatric examination. The case was remanded.
