Recognition of a share as insignificant: criteria for a co-owner’s material interest

The court of first instance recognized the defendant’s share (1/4) as insignificant and terminated the ownership right. The appellate court reversed the decision, concluding that the co-owner had a material interest based on the long-term ownership of the plots (21 years) and their use for growing agricultural crops. 

The Russian Supreme Court disagreed: the length of ownership alone, without evidence of actual need, does not demonstrate a material interest. The case was sent back for a new hearing in the appellate court.
