Notaries to Inform Heirs of Decedents’ Debts
As of November 24, 2025, amendments to the law have come into force, obligating notaries to actively identify the debts of decedents. Henceforth, after the opening of the inheritance, notaries will send a request to the Central Catalogue of Credit Histories (CCCH) for the purpose of identifying the decedent’s credit history.
Furthermore, according to the new law, notaries are obliged to notify the heirs about the debts within 3 days of receiving information from the credit bureaus. Notification will be sent by mail, electronic mail, or delivered in person.
Previously, such a procedure was not provided for – the notary only provided the heir with data on the bureau where the decedent’s credit history was stored, and only upon the heir’s request.
Thus, heirs will now be able to learn in advance the full information about the debts and make an informed decision – to accept the inheritance with the debts or to renounce it, since, by accepting the assets as part of the inheritance, the heirs also assume the decedent’s debts, provided the debt amount does not exceed the value of the assets.
