Intellectual Property Protection
- Defending the interests of a software developer who entered into a software license agreement with a Russian legal entity. The licensee attempted to artificially create grounds for early termination of the contract and return of funds. The lawyers collected evidence confirming the licensee’s use of the software and protected the developer’s rights in court.
- Defended the interests of the client in a project for early termination of legal protection of a trademark. The lawyers advised the client on establishing the evidentiary basis to support the use of the trademark in the Russian Federation and represented the client in court. The client uses the trademark for individualization of goods and services in the Russian Federation and EU countries.
- Drafting a trademark license agreement providing for a complicated system of royalty payment.
- Due diligence, structuring and support of the acquisition of a Russian telemedicine platform developer. The lawyers’ work included identifying risks connected with registration of rights to the developed software, loss of rights, filing claims by third parties for compensation for infringement of exclusive rights to the software, consulting with IT specialists in order to identify code borrowed from software previously assigned to third parties.
- Represented a client, one of the company’s beneficiaries, in challenging a major transaction – an agreement to alienate the company’s exclusive right to a trademark on unfavorable terms. As a result of the lawsuit, the trademark rights were returned to the client.
- Advising a cybersports club and drafting agreements with the club’s sponsors, including transfer of rights to use trademarks and commercial designations used by the club.
- Drafting documentation certifying the rights of three authors to a literary work for the purpose of which the editor was hired.
- Development of an agreement to exercise the rights of the authors.
