Supporting inheritance cases involving the distribution of complex assets among heirs
- Implementing complex projects involving foreign assets and corporate structures in which clients needed to dispose of their assets in a certain manner in the event of death.
- Representation and counseling of clients, business owners and wealthy individuals whose assets include both movable (shares in operating and holding companies) and immovable property (buildings, premises and land plots) located in Russia. As a rule, the clients’ assets were jointly owned by spouses.
Inheritance law
- Advising and representing the owner of a major real estate development company, for which we drafted and provided support for a prenuptial agreement modifying the ownership regime of the family assets, and a will that determined the distribution of assets among the heirs, with provisions for sub-assigning heirs, appointing an executor, etc.
- Advising the owner of a popular cosmetics chain, whose heirs include minor children, we drafted and accompanied the preparation of a joint will of spouses, providing for a complex procedure for the transfer of shares in companies by inheritance, the appointment of executor, charging him with property and non-property obligations.
- Representing a senior manager at a major transportation corporation in Russia, for whom we drafted and accompanied the preparation of a joint will that provided for a complex procedure for distributing the inherited property among the client’s minor heirs, the procedure for appointing successors, as well as legally excluding the application of the rules on the mandatory share of the inheritance of the client’s property.
- Representing a Swiss citizen, the legal representative of the client’s underage heirs to the estate of the client’s deceased father (a Russian citizen). The matter was complicated by the existence of another heir under a will governed by English law and providing for the creation of a trust. The firm’s lawyers prepared a legal opinion on the implementation of the will under English law, collected and submitted documents to the notary for the opening of the inheritance case, conducted negotiations with the notary.
- Structuring a project for the transfer of the client’s retail business under the will, the development of various options for planning the inheritance. Creation of holding company for the purpose of transfer by inheritance, preparation of corporate documents reflecting the client’s needs.
