The RF Constitutional Court (CC) allowed courts to decrease statutory penalties for violating intellectual property rights

The RF CC declared that provisions of Section 4 of RF Civil Code on mentioned statutory penalties are unconstitutional as the current procedure on determining such penalties does not provide courts with an opportunity to reduce them below the minimum statutory limit. Following this RF CC Ruling courts now have the right to reduce compensation due to circumstances of a specific case (e.g. if the offence is committed for the first time, etc.).
