RF Supreme Court held against gender bias in live-with child disputes

Child disputes resolving with which parent the child shall live after parents’ divorce or separation are typically resolved by Russian courts in favor of the mother.
The RF Supreme Court, resolving a recent case, held that there shall be no gender bias and the fathers shall have the same parental rights as the mothers have (see s. 7 of the Review of Judicial Practice of RF Supreme Court No. 1 (2024)).
The court stated that such disputes should be resolved on the basis of equality between parents’ rights, without preferring to leave the child with the mother and taking into account the child’s opinion.
