Ministry of Finance (MoF) clarifies the division of marital property

In the letter dated 15.03.2017 MoF reviewed the scenario of martial property division in which one of the spouses received in-kind disbursements exceeding the actual value of his/her share, while the other received a monetary compensation. MoF assumes that the compensation is subject to personal income tax if paid under a separation agreement executed after a divorce since family law regulations do not apply to transactions between ex-spouses. Russian courts, however, have not yet expressed any opinion on the matter.
